On September 1, 2026, the Department of Justice (DOJ) released a new legal opinion that says that the Department of Health and Human Services (HHS) may condition funding for programs that serve low-income people on states sharing information with DHS about people whom states “know” are not lawfully present. This legal opinion does not change HHS or any other federal agency’s policy or state requirements on its own.
