What is public charge?

The public charge inadmissibility test applies when a person applies for a green card or for a visa. Many immigrants are exempt from public charge by laws that cannot be changed by regulations.

The latest updates

On November 17, 2025, the U.S. Department of Homeland Security published a notice of proposed rulemaking on public charge.  

PIF is reviewing the proposed rule and preparing materials that will be available soon.

The Biden public charge rule is still in effect until a new rule is finalized.
